Basic Information
The
Appeal process timeframe.
Completed Application and all
required Documentation is filed with the Town Clerk, starts the
process. The Board has 65 day's to schedule a public hearing. The
Board has 100
day's, from the start of the process, to render a decision on a Variance.
The Board has 90 day's, from the close of the hearing, to render a
decision on a Special
Permit.
The public hearing must be
published in a local newspaper for two consecutive weeks and the
first week cannot be closer than two weeks to the public hearing
date.
When the public hearing is
closed, and the petition is granted or denied/withdrawn, the board
has 14 day's to file it's decision with the town clerk.
From the date we file with the
town clerk there is a twenty day appeal period where anyone
aggrieved by our decision may appeal it to the Superior Court.
If after twenty day's there are
no appeals to Superior Court, bring your Mylar to the Town Clerks
Office and it will be signed. You will want to bring your
Mylar and Decision to the Registry of Deeds for Recording. They will
give you a Signed receipt/paperwork that you must bring with you
when you return to the building department for your building permit.

Planning your
project.
Most construction you do to your
home or property requires a building permit. Please call the
building department (781-961-0921) if you are unsure. Today's Zoning
By-Laws require that your Lot be a minimum of 12,000 sq. ft. for a
Single Family Residential. Along with that it requires certain setbacks
from your property line. (See
Table of Dimensional Requirements)
From the street to the front of
your house is a minimum of 25 feet.
From the side property line,
either left or right, is a minimum of 15 feet.
From the rear property line the
minimum is 15 feet.
It also requires that you have a
minimum of 100 feet of frontage.
If you do not meet any one of
these items, or others that are not listed, and you are denied a
building permit. You can request relief from the Board of Appeals.
Applications to seek relief from
the Board of Appeals can be picked up at the Town Clerks Office
during normal business hours (781-961-0900).
If you are aggrieved by a
decision of the Building Department, within 30 day's you may file an
Appeal to the Board of Appeals.
